Terms and Conditions

1. Agreement, eligibility and accounts

These Terms are an agreement between you and Pragmati Networks LTD, Ramat Gan, Israel("Mona", "we", "us"), and govern your use of the Mona app and website (the "Service"). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 16 years old, and if you are under 18 you need a parent or guardian's permission. You are responsible for keeping your login details safe and for everything done through your account. Tell us if you suspect unauthorised use.

2. The Service and AI-generated content

Mona is a language-practice tool. Mona's messages, voice replies, corrections, translations, explanations, word glosses and feedback ("AI Output") are generated automatically by third-party artificial intelligence models, not written or reviewed by a person. By using the Service you understand and agree that:

  1. AI Output may be wrong. It can contain grammatical, factual, cultural or translation errors, and may be incomplete, inconsistent, outdated or unsuitable for your level or purpose. A correction may mark something wrong that is right, or miss a real mistake.
  2. AI Output may be unexpected or offensive. Despite safeguards, Mona may occasionally say something inappropriate, biased or upsetting. We do not endorse any AI Output, and it does not represent our views.
  3. It is not professional advice. Mona is not a certified teacher, translator, interpreter, or medical, legal, financial or psychological adviser. Do not rely on AI Output for exams, official or legal documents, safety, health, travel, business or any decision with real consequences. Check anything important with a qualified human.
  4. Mona is not a person. It is an AI character. Do not treat it as a friend, counsellor or emergency service. If you are in crisis, contact local emergency services.
  5. You use AI Output at your own risk. To the fullest extent the law allows, we are not responsible for AI Output, for how you use it, or for any loss or harm arising from relying on it.

We may change, add or remove features, AI providers, models, languages and limits at any time.

3. Free use, subscriptions and payments

You can use a limited number of free conversation actions. Unlimited use needs a paid subscription, billed monthly or yearly at the price shown at checkout.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Your purchase is also subject to Paddle's Buyer Terms.

  • Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time, and access continues until the end of the period you paid for.
  • Prices may include or add sales tax or VAT depending on your country. We will tell you before any price change applies to your next renewal.
  • You can get a full refund within 14 days of your first payment or a yearly renewal, as set out in our Refund Policy. Refunds are handled by Paddle. Nothing here limits rights you have under consumer law where you live, including any EU or UK right of withdrawal.
  • If a payment fails, we may pause paid features until it succeeds.
  • Deleting your account cancels your subscription immediately, and you will not be charged again.

4. Acceptable use and your content

You agree not to:

  • use the Service for anything unlawful, harmful, harassing, hateful or sexually explicit, or try to get Mona to produce such content;
  • share other people's personal data, or sensitive data about yourself you would not want processed by AI providers;
  • try to bypass usage limits, payment, security or safety filters, or reverse-engineer, scrape or overload the Service;
  • resell or share your account, or use the Service to build a competing product or train AI models.

Your content. What you type or say ("Your Content") stays yours. You give us a worldwide, non-exclusive, royalty-free licence to host, process and transmit Your Content, including to our AI providers, only to run and improve the Service as described in the Privacy Policy. You are responsible for Your Content and confirm you have the right to share it. As between you and us, you may use AI Output for your own personal learning.

We may suspend or remove access if you break these rules.

5. Our property and third-party services

The Service, including the Mona name, character, logo, design, software and content we create (other than Your Content), belongs to us or our licensors. We give you a personal, non-transferable, revocable right to use the Service for your own language learning while these Terms apply.

The Service relies on third parties, including AI providers (OpenAI, Google, xAI, Anthropic), hosting (Vercel), database and sign-in (Supabase, Google) and payments (Paddle). We are not responsible for their outages, errors or policies, and their own terms may also apply to you.

6. Disclaimers, limitation of liability and indemnity

No warranties. The Service and all AI Output are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including accuracy, fitness for a particular purpose, merchantability, non-infringement, and that the Service will be uninterrupted, error-free or meet your learning goals. We do not guarantee any learning result or exam outcome.

Limitation of liability. To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, opportunities or goodwill, or for any loss arising from AI Output or from relying on it. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50.

Consumer rights. Some countries do not allow certain exclusions or limits. Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or any other liability or consumer right that cannot be excluded by law.

Indemnity. You agree to compensate us for claims, losses and reasonable costs arising from your breach of these Terms or your misuse of the Service, including Your Content.

7. Ending, changes, governing law and contact

Ending. You can stop using the Service and delete your account at any time in Settings. We may suspend or end your access if you breach these Terms, if required by law, or if we discontinue the Service; if we discontinue a paid Service without cause, we will refund the unused part of your current period. Sections 2, 4, 5, 6 and 7 survive.

Changes. We may update these Terms. We will post the new version with a new date, and for material changes give notice in the app or by email at least 14 days before they apply. Continuing to use the Service after that means you accept them.

Governing law. These Terms are governed by the laws of the State of Israel, and the courts of Tel Aviv-Jaffa have exclusive jurisdiction, unless the consumer law of your country gives you the right to bring a claim in your local courts.

General. If any part of these Terms is unenforceable, the rest stays in effect. Not enforcing a right is not a waiver. These Terms and the Privacy Policy are the entire agreement between us about the Service.
